29 CFR 1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, as required by 29 CFR 1926.503(a), the employer shall retrain such employee.  The employer is failing to retrain employees to ensure that all employees are retaining the requisite understanding regarding the fall hazards associated with the type of work being accomplished and the procedures to be followed to minimize exposure to these hazards when employees' failure to utilize fall protection indicate the need for retraining. This was most recently documented on or about April 21, 2021 at 10318 S 188th St., Gretna NE 68028.   An employee who was previously observed during inspection 1512009 on December 3, 2020 performing residential construction activities 6 feet (1.8 m) or more above lower levels without the use of fall protection was not retrained as required by 29 C.F.R. 1926.503(c).

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.  The employer is failing to protect employees from fall hazards when conducting roofing operations on a residential structure. This was most recently observed on or about April 21, 2021 at 10318 S. 188th St., Gretna Nebraska, 68028. Four employees were working on the roof of a residential structure installing roofing felt on a newly constructed residential home at heights of over 6 feet and not utilizing any form of fall protection.   Francisco Esquivel was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1512009, citation number 1, item number 1 and was affirmed as a final order on April 6, 2021, with respect to a workplace located at 4311 George Miller Pkwy, Elkhorn, NE 68022.  Francisco Esquivel Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1394589, citation number 1, item number 1 and was affirmed as a final order on June 27, 2019, with respect to a workplace located at 18314 Grant Street, Elkhorn, NE 68022.  Francisco Esquivel was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1386235, citation number 1, item number 1 and was affirmed as a final order on November 5, 2019, with respect to a workplace located at 7656 Von St, Papillion, NE 68046.  Fransisco Esquivel Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1366549, citation number 1, item number 1 and was affirmed as a final order on July 29, 2019, with respect to a workplace located at Corner Of 208th St. & Boyd St., Elkhorn, NE 68022  Francisco Esquivel was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1349124, citation number 1, item number 1 and was affirmed as a final order on January 16, 2019, with respect to a workplace located at 19256 Ames Circle, Omaha, NE 68116.  Francisco Esquivel Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1335198, citation number 2, item number 1 and was affirmed as a final order on January 16, 2019, with respect to a workplace located at Cove Hollow Circle Lot 33, Papillion, NE 68046.  Francisco Esquivel was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1163496, citation number 1, item number 1 and was affirmed as a final order on April 12, 2017, with respect to a workplace located at 2202 176th St, Elkhorn, NE 68022.
