29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling:   Storage Bldg., Mezzanine: A 9 ft. high platform was accessed by employees to store various bulk items and the inadequately constructed guardrails did not protect employees from fall hazards  for the following reasons;    a.  An approximately 3 ft. section of standard guardrails was missing from the left side of the mezzanine.   b.  The front length of the storage mezzanine was missing mid-rails.

29 CFR 1910.29(k)(1): (k)  The employer must ensure toeboards used for falling object protection.   Storage Bldg., Mezzanine: A 9 ft. high platform is accessed by employees to store various bulk items.  Toeboards were not integrated into the guardrail system.  Toeboards should have a minimum vertical height of 3.5" from the level of the walking-working surface to the top edge of the toeboards.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    Maintenance: Employees performing electrical repairs and maintenance on HVAC systems are exposed to hazards associated with the accidental release of stored energy types such as electrical and mechanical (belts,  pulleys, fan blades).  Although a process is followed, procedures are not in writing and do not encompass the requirements of this section.
