29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck:(Construction Reference: 1926.602(d))  At the location of 12151 S. Strangline Ct, in Olathe KS, a forklift operator moving scaffolding material with the use of a Caterpillar forklift (SN-ML501537) and employees near the forklift were exposed to struck-by hazards in that the operator had not successfully completed the training for operating the forklift.

29 CFR 1926.451(e)(1): 29 CFR 1926.451(e)(1): Cross braces were used as a means of access and egress:  At the location of 12151 S. Strangline Ct, in Olathe KS, employees ascending onto the scaffold were exposed to fall hazards of approximately 36 to 42 feet to the ground below in that the cross braces were used as a means to climb to the next level in lieu of ladders.
