29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, or similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 29 CFR 1915.71(j)(1) and (2): m/v "Alegria" on the marine railway: An employee was performing cleaning and maintenance operations on the windows onboard the vessel. The employee accessed the vessel by the swim step, which was an unprotected edge elevated 93 inches above the lower level. The employee was exposed to a fall hazard.

29 CFR 1915.74(a)(1): A gangway of not less than 20 inches walking surface of adequate strength, maintained in safe repair and safely secured was not used. If a gangway is not practical, a substantial straight ladder, extending at least 36 inches above the upper landing surface and adequately secured against shifting or slipping was not provided. When conditions are such that neither of gangway nor a straight ladder can be used, a Jacob's ladder meeting the requirements of (d)(1) and (2) were not used. m/v "Alegria" on the marine railway: An employee was performing cleaning and maintenance operations on the windows onboard the vessel. The employee accessed the vessel by use of a mobile staircase, which did not reach the upper landing of the vessel. The employee had to climb over the guardrail of the mobile staircase to reach the swim step. The employee was exposed to a 93-inch fall hazard.
