29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. The employer failed to ensure that the eyes of employees are protected from flying particles while working on a residential roof. This most recently occurred on or about April 08, 2019 on the jobsite located at 6717 N. 160th Street, Omaha, Nebraska 68116. Employees were observed using hand-held pneumatic nail guns to perform roofing operations on a residential home without any form of eye protection exposing them to eye injuries.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: The employer is failing to protect employees from fall hazards when conducting roofing operations on residential structures. This was most recently documented at 6717 N. 160th Street, Omaha, Nebraska on or about April 08, 2019 when employees were observed installing shingles on a residential structure while working at height greater than 6 feet above the ground without fall protection. Leo Garcia Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection #1356734, citation #1, item #1, and was affirmed as a final order on 4-4-19, with respect to a workplace located at 827 195th Street, Omaha, NE 68122.
