29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: a) Vigor Shipyard/ USCG Healy; On or about April 9, 2019; The employer did not identify, evaluate and estimate employee exposures to airborne concentrations of solvents and other hazardous substances in industrial marine paint (including but not limited to: 1-Butanol, titanium dioxide, ethylbenzene, xylene, and trimethylbenzene). The employer did not accurately determine employee exposure during painting operations which included spray painting and tank painting.

29 CFR 1910.134(d)(3)(iii)(B)(2): The employer did not implement a change schedule for respirators not equipped with an End of Service Life Indicator that would ensure cartridges were changed before the end of their service life: a) Vigor Shipyard / USCG Healy; On or about April 9, 2019; The employer did not have a specific organic vapor cartridge change out schedule for employees who were painting with Amercoat 240 Resin DV2904 Haze Grey, Seaguard 5000 HS Epoxy Hi-Solid Epoxy Coating (Part A), Gray or Seaguard 5000 HS Hi-Solid Epoxy Coating (part B) Clear Hardener. Note: The employer may provide an air-purifying respirator provided the respirator is equipped with end-of-service-life indicators or a change schedule has been developed. Otherwise, the employer must provide an atmosphere-supplying respirator. The employer has a change out scheduled, but did not have it available on site at the time of the inspection.
