29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, and in the alternative, did not properly assesses the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a) Haddon Point, 2100 Haddonfield Road, Pennsauken, NJ: On or about April 10, 2019, New View Construction LLC employees were installing block on the walls of an elevator shaft for a new construction, multi-family, apartment style residential structure. Employees were using Stihl concrete saw to cut masonry block. The saw was not equipped with engineering controls conforming to Table 1 Section (xi) of this standard creating a visible cloud of dust that potentially contained respirable silica. Additionally, the employer had not conducted a proper assessment of potential employee exposure to respirable crystalline silica. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
