29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) Top, east side of building: Employees without fall protection, approximately 34.5' above ground level were preparing to install sheeting on the roof top, on or about 04/17/2019; b) Southeast corner 2nd floor: Employee without fall protection, approximately 15.5' above ground level was installing a 2 x 12s on the exterior corner of the building, on or about 04/17/2019; c) Southeast corner 3rd floor: Employee without fall protection, approximately 25' above ground level was installing a 2 x 12s on the exterior corner of the building, on or about 04/17/2019. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(15): Ladders were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could affect their safe use: a) Southeast corner of building: A competent person did not inspect the 28' aluminum extension ladder used by employees, who worked from and used the ladder to access the 2nd floor level approximately 15' above ground level while attaching approximate 2" x 12" x 12' pieces of lumber to the exterior corner, at the southeast corner of the building; damage included at least one broken rung, on or about 04/17/2019. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(16): Portable ladder(s) with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired: a) Southeast corner of building: Employees used the damaged 28' unidentifiable, aluminum extension ladder to access the upper parts of the exterior corner and the open sided floor at the corner of the 1st floor level had not been marked as defective and removed from service, on or about 04/17/2019. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
