29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toe-boards, safety net systems, or personal fall arrest systems: (a)Brothers, LLC at 1201 South Hyde Park Avenue, Sioux Falls, SD 57106: On or about and at times prior to April 23, 2019, the exposing employer did not ensure employees performing roofing activities were protected from fall hazards. Employees were working on a 6-in-12 pitched roof at heights greater than 6 feet above ground level were protected from fall hazards by use of appropriate fall protection systems. This condition exposed employees to fall hazards between 10 and 20 feet.

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head: (a)Brothers, LLC at 1201 South Hyde Park Avenue, Sioux Falls, SD 57106: On or about and at times prior to April 23, 2019, the exposing employer did not ensure employees were protected from fall hazards in that, an employee was observed with the back D-ring not positioned in the center of the wearer's back at shoulder level. The lanyard snap-hook was connected to the wearer's back D-ring located at the employees' waist. This condition exposed one employee to fall hazards of 10 to 20 feet.
