29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Brothers Construction, LLC @ 14648 423rd Avenue, Bristol, SD 57219: On or about and at times prior to September 1, 2020, the exposing employer did not ensure a forklift operator was trained in the operation of powered industrial trucks in that, prior to using rough terrain forklifts.  Two rough terrain forklifts were used to lift corrugated steel decking material and a personnel basket to perform roofing activities. This condition exposed the employee to the hazard of improper forklift operation.   Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  Abatement Note: The requirements applicable to construction work under 1926.602(d) are identical to those set forth at �1910.178(l) of this chapter. 29 CFR  1926.502(a)(2): Employers did not provide and install all fall protection systems required by this subpart for an employee, and did not comply with all other pertinent requirements of this subpart before that employee began the work that necessitated the fall protection:  (a)Brothers Construction, LLC @ 14648 423rd Avenue, Bristol, SD 57219: On or about and at times prior to September 1, 2020, the exposing employer did not ensure employees were protected from fall hazards while using Guardian vertical lifelines while installing corrugated steel roof panels on a wooden pole-to-truss cattle barn under construction.  Employees were taking the snap-hook of vertical lifelines and looping it around the top chord of the truss and connecting it back onto the lifeline rope. The vertical lifeline was not designed this anchorage application.  This condition exposed an employee to a fall hazard of approximately 16 feet. 29 CFR  1926.502(d)(21): Personal fall arrest systems were not inspected prior to each use for wear, damage and other deterioration, and defective components were not removed from service:  (a)Brothers Construction, LLC @ 14648 423rd Avenue, Bristol, SD 57219: On or about and at times prior to September 1, 2020, the exposing employer did not ensure that each personal fall arrest system was inspected prior to use, and that defective components were removed from service. Employees were using a Guardian 50-foot Poly Steel Rope Vertical Lifeline assembly part #01320, as a part of the personal fall arrest systems used during the installation of steel corrugated roofing panels on a post-and-truss cattle barn. This condition exposed employees to a fall hazard of approximately 16 feet. 29 CFR  1926.760(a)(1): Each employee engaged in steel erection activity who is on a walking/ working surface with an unprotected side or edge more than 15 feet above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems.  (a)Brothers Construction, LLC @ 14648 423rd Avenue, Bristol, SD 57219: On or about and at times prior to September 1, 2020, the exposing employer did not ensure an employee was protected from fall hazards while installing 42-foot long by 3-foot wide corrugated steel roof decking material on the roof of a wooden pole-to-truss cattle barn under construction.  Employees were utilizing a Guardian 50-foot Poly Steel Rope Vertical Lifeline assembly as a fall protection system while working on the roof. Employees were disconnecting the lifeline snap-hook from the anchor which consisted of the wooden trusses and walking to the next area where roof panels were being installed without the protection of a fall protection system. This condition exposed an employee to a fall hazard of approximately 16 feet. 29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written certification record:  (a)Brothers Construction, LLC @ 14648 423rd Avenue, Bristol, SD 57219: On or about and at times prior to September 1, 2020, the exposing employer did not ensure a written fall protection training certification record was prepared which included the identifies of employees trained, dates of training, and the signatures of the trainer or employer. Employees were working on the roof of a post-to-truss cattle barn installing steel corrugated roof panels while improperly using vertical lifelines looped around trusses with the snap-hook connected directly to the rope. This condition exposed an employee to a fall hazard of approximately 16 feet.  Abatement Note: The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  Brothers Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.503(b)(1), which was contained in OSHA inspection number 1395838, citation number 1, item number 1c, and was affirmed as a final order on July 24, 2019, with respect to a workplace located at 1201 South Hyde Park Avenue, Sioux Falls, SD 57106.
