OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees of being caught-in-between or crushed by the rotating superstructure of the of a crane and the outriggers:     (a)Gage Brothers Concrete Products, Inc. at 4301 West 12th Street, Sioux Falls, SD 57106:  On or about and at times prior to April 17, 2019, the employer did not ensure employees were protected from caught-in-between hazards related to the rotating superstructure of the crane and outrigger posts. The Linkbelt HC 218 mobile crane, serial #18HA383, was not equipped with a barricade to prevent employee exposure to the tail-swing of the crane. This condition exposed employees to caught-in-between hazards.       Among other methods, feasible and acceptable methods to correct this hazard is to comply with paragraph 5-3.2.1.5(a)(4) of the American Society of Mechanical Engineers (ASME) B30.5 - 2007, Mobile and Locomotive Cranes Safety Standard for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings which states, "The person directing the lift shall see that all persons are clear of the swing radius of the crane counterweight;" and/or, paragraph 4 on page 3 of the Association of Equipment Manufacturers, Mobile Crane Safety Manual for Operators and Maintenance Personnel which states, "Be sure there is adequate clearance for tail swing. Barricade the area to prevent entry."

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees related to struck-by hazards as a result of a falling boom, load and/or components:    (a)Gage Brothers Concrete Products, Inc. at 4301 West 12th Street, Sioux Falls, SD 57106:  On or about and at times prior to April 17, 2019, the employer did not ensure employees were protected from struck-by hazards associated with operational deficiencies related to an inadequate braking system on the whip or auxiliary hoist, numerous hydraulic leaks, and a leaking torque convertor. The employer did not correct identified deficiencies prior to operation of the Linkbelt HC 218 , serial #18HA383 mobile crane. This condition exposed employees to struck-by hazards.      Among other methods, feasible and acceptable methods to correct this hazard is to comply with paragraph 5-2.3.3(a) through (b) of the American Society of Mechanical Engineers (ASME) B30.5 - 2007, Mobile and Locomotive Cranes Safety Standard for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings which states, "Any hazardous conditions disclosed by the inspection requirements of Section 5-2.1 shall be corrected before operation of the crane is resumed." Adjustments and repairs shall be done only be designated personnel. (b) Adjustments shall be made within the manufacturer's specified tolerances to maintain correct functioning of the components. The following are examples:    (1) functional operating mechanisms  (2) operational aids  (3)pneumatic, electronic, hydraulic, and mechanical control systems  (4) power plants  (5)braking systems

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling:     (a)Gage Brothers Concrete Products, Inc. at 4301 West 12th Street, Sioux Falls, SD 57106:  On or about and at times prior to April 17, 2019, the employer did not ensure employees were protected from fall hazards. Employees were accessing the top of precast concrete panels to connect and release rigging without the use of a fall protection system. Employees were exposed to a fall hazard of approximately 10 feet.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel.    (a)Gage Brothers Concrete Products, Inc. at 4301 West 12th Street, Sioux Falls, SD 57106:    On or about and at times prior to April 17, 2019, the employer did not ensure two Yale forklifts were maintained in a safe operating condition and removed from service when the unsafe conditions were identified in that, one of the forklift had brakes that were inadequate, damaged tires, a cracked windshield and the back-up alarm was inoperable. These conditions exposed the employees to the hazards of an unsafe forklift.

29 CFR 1910.178(q)(7): The employer did not ensure industrial trucks were examined before being placed in service.  Such examination shall be made at least daily. Defects when found shall be immediately reported and corrected.    (a)Gage Brothers Concrete Products, Inc. at 4301 West 12th Street, Sioux Falls, SD 57106:  On or about and at times prior to April 17, 2019, the employer did not conduct a daily inspection of each forklift prior to putting into service at the steel fabrication shop.  Multiple defects were identified by employees while each machine remained in service. These conditions exposed the employees to the hazards of and unsafe forklift.

29 CFR 1910.213(c)(1): The employer did not ensure that each circular hand-fed ripsaw was guarded by a hood which completely enclosed that portion of the saw above the table and that portion of the saw above the material being cut:    (a)Gage Brothers Concrete Products, Inc. at 4301 West 12th Street, Sioux Falls, SD 57106: On or about and at times prior to April 17, 2019, the employer did not ensure the blade guard for the Saw Stop brand table ripsaws located in the shipping and receiving was completely enclosing the portion of the saw above the table. The blade guard was removed and an employee was using the saw while ripping plywood without a blade guard in place. This hazard exposed the employee to amputation and caught-in hazards.     Abatement note: The hood and mounting of the blade guard shall be arranged so that the hood will automatically adjust itself to the thickness of and remain in contact with the material being cut but it shall not offer any considerable resistance to insertion of material to saw or to passage of the material being sawed. The hood shall be made of adequate strength to resist blows and strains incidental to reasonable operation, adjusting, and handling, and shall be so designed as to protect the operator from flying splinters and broken saw teeth. It shall be made of material that is soft enough so that it will be unlikely to cause tooth breakage. The hood shall be so mounted as to insure that its operation will be positive, reliable, and in true alignment with the saw; and the mounting shall be adequate in strength to resist any reasonable side thrust or other force tending to throw it out of line.
