29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)Mart Brothers, Inc. at 8804 West 18th Street, Sioux Falls, SD 57106: : On or about and at times prior to April 23, 2019, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees were exposed to fall hazards related to conducting re-roofing operations on 5-in-12 pitched roof. The condition exposed subcontractor employees to fall hazards up to 15 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: (a)Mart Brothers, Inc. at 8804 West 18th Street, Sioux Falls, SD 57106: On or about and at times prior to April 23, 2019, the controlling employer did not ensure subcontractor employees were protected from fall hazards by guardrail systems, safety net systems, personal fall arrest system or warning line system and safety monitor system. Subcontractor employees were conducting re-roofing operations on a single family home with a roof pitch of 5-in-12 while not utilizing a fall protection system. This condition exposed subcontractor employees to a fall hazards up to 15 feet.
