29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)Mart Brothers Construction, Inc. at 4201 South Oxbow Avenue, Sioux Falls, SD 57106: On or about and at times prior to October 20, 2022, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontracted employees were conducting roofing operations on a commercial property without the use of a fall protection system on site. This condition exposed employees to fall hazards of greater than six feet. Mart Brothers Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1401323, citation number 1, item number 1, and was affirmed as a final order on August 28, 2019, with respect to a workplace located at 325 Joplin Street, Vermillion, SD 57069.

29 CFR 1926.501(b)(10): Employees engaged in roofing activities on high-slope roofs with unprotected sides and edges 6 feet or more above lower levels, were not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail systems, warning line system and safety net system, warning line system and personal fall arrest system, or warning line system and safety monitoring system: (a)Mart Brothers Construction, Inc. at 4201 South Oxbow Avenue, Sioux Falls, SD 57106: On or about and at times prior to October 20, 2022, the controlling employer did not ensure that subcontracted employees were protected from falls while conducting roofing operations on a commercial roof. This condition exposed the employees to fall hazards greater than six feet. Mart Brothers Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1396611, citation number 1, item number 2, and was affirmed as a final order on September 10, 2019, with respect to a workplace located at 8804 West 18th Street, Sioux Falls, SD 57106.
