29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure under another provision of paragraph 1926.501 (b) appropriately implement: (a)LM Construction, LLC at Silverthorne Flats, South Silverthorne Avenue, Sioux Falls, SD 57110: On or about and at times prior to May 1, 2019, the exposing employer did not ensure an employee was protected from fall hazards when cutting straps on a bundle of roof trusses without utilizing appropriate fall protection. This condition exposed one employee to a fall hazard on approximately 33 feet. (b)LM Construction, LLC at Silverthorne Flats, South Silverthorne Avenue, Sioux Falls, SD 57110: On or about and at times prior to May 1, 2019, the exposing employer did not ensure an employee was protected when performing work standing on an exterior top plate without utilizing appropriate fall protection. This condition exposed one employee to a fall hazard on approximately 33 feet.

The work platform over the elevator shaft on the third floor was not labeled to identified it as a hole or cover. This condition exposed employees to a fall hazard.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. (a)LM Construction, LLC at Silverthorne Flats, South Silverthorne Avenue, Sioux Falls, SD 57110: On or about and at times prior to May 1, 2019, the exposing employer did not ensure an employee was protected from fall hazards when performing work on scaffolding. An employee was working on scaffolding or a temporary work platform near the elevator shaft of the third floor that was approximately 13' above floor level. The platform did not provide any means of fall protection. This condition exposed an employee to a fall hazard of approximately 13 feet. (b)LM Construction, LLC at Silverthorne Flats, South Silverthorne Avenue, Sioux Falls, SD 57110: On or about and at times prior to May 1, 2019, the exposing employer did not ensure employees were protected from fall hazards when performing work on scaffolding or an interior wall temporary platform located on the third story of a multi-family residence under construction. The company's fall protection plan required temporary platforms to be installed approximately 42 inches below the exterior top plate to provide fall protection from a fall to the exterior. The temporary platform was however, installed approximately 36 inches from the exterior top plate. This exposed employees performing work on the scaffolding to an approximate 33' fall hazard to the exterior of the building.
