29 CFR 1926.200(g)(2):  All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference:      (a) On May 1, 209, located at the intersection of S. Cooper Ave. & Lock Street, Lockland, OH an employee was performing flagging operations during a Temporary Traffic Control Zone was exposed to struck-by hazards not utilizing the appropriate devices such as STOP SLOW paddle that conform to Part VI of the Manual of Uniform Traffic Control Devices.

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.     On May 1, 209, located at the intersection of S. Cooper Ave. & Lock Street, Lockland, OH an employee observed inside an excavation that measured to be 7'-9" in depth in that there were no suitable safe means located within 25' inside the excavation for the employee to access/egress safely.

29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline.    On May 1, 209, located at the intersection of S. Cooper Ave. & Lock Street, Lockland, OH an employee was working in an excavation in which water was accumulating and that no adequate protected system was installed or water removing system, or safety harness and lifeline used to protect the employee from cave-in hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    On May 1, 209, located at the intersection of S. Cooper Ave. & Lock Street, Lockland, OH an employee working in an excavation 7'-9" in depth without adequate protection against cave-ins, in that the walls of the excavation were not properly sloped, shored, benched or otherwise adequately protected against collapse.
