29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: -Excavations are made entirely in stable rock; or -Excavations are less than 5 feet (1.52m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in.  a.) On March 29, 2023, the employer failed to ensure that employees were protected from cave-in hazards by an adequate protective system  in that, employees were found working in a trench without cave-in protection. The trench measured up to 7' deep, with straight vertical sidewalls.  Welsh Excavation Company, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1397569, citation number 1, item number 3b and was affirmed as a final order on July 19, 2019, with respect to a workplace located at the Intersection of S. Cooper Ave. & Lock Street Lockland, OH 45215 .
