29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):     On 09 May 2019, at a worksite located at 1615 Millview Drive, Batavia IL 60510, employees who were removing and replacing a chimney cap on the roof of a residential structure were exposed to fall hazards of approximately 9 feet.  No form of fall protection was being utilized during this work activity.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    On 09 May 2019, at a worksite located at 1615 Millview Drive, Batavia IL 60510, employees who were removing and replacing a chimney cap on the roof of a residential structure were not trained adequately to recognize the hazards of falling and the steps to mitigate those hazards.  No form of fall protection was being utilized during this work activity, exposing employees to falls of approximately 9 feet.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    On 09 May 2019, at a worksite located at 1615 Millview Drive, Batavia IL 60510, employees of FIREPLACE AND CHIMNEY AUTHORITY, INC, who were engaged in residential construction operations were using a metal extension ladder that was not extended to at least three feet above the eave to allow for safe access to the roof. This exposed employees to a fall of approximately 9 feet onto concrete below.     Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).
