29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying and correcting existing hazards):  (a)Xcel Roofing of Siouxland, LLC at 509 South Whitewood Avenue, Sioux Falls, SD 57106: On or about and at times prior to May 13, 2019, the controlling employer did not initiate and maintain a safety program to provide for frequent and regular competent person jobsite inspections in that a representative of the controlling employer observed subcontractor employees  on the jobsite on May 13, 2019 at approximately 9:16 AM performing roofing work at a height greater than 6 feet above ground level not appropriately using fall protection. Subcontractor employees were; (1) wearing a harness that was not attached to any fall protection system, (2) tangled in rope grab lines when working on the roof and (3) using rope grab fall protection system inappropriately by attaching the lanyard of the rope grab to the chest strap of their harness.  This condition exposed subcontractor employees to fall hazards.  (b)Xcel Roofing of Siouxland, LLC at 509 South Whitewood Avenue, Sioux Falls, SD 57106: On or about and at times prior to May 13, 2019, the controlling employer did not initiate and maintain a safety program to provide for frequent and regular competent person jobsite inspections in that a representative of the controlling employer observed subcontractor employees  on the jobsite on May 13, 2019 at approximately 11:49 AM performing roofing work at a height greater than 6 feet above ground level not appropriately using fall protection. A subcontractor employee was wearing a harness that was not attached to any fall protection system.  This condition exposed subcontractor employees to fall hazards.  (c)Xcel Roofing of Siouxland, LLC at 509 South Whitewood Avenue, Sioux Falls, SD 57106: On or about and at times prior to May 13, 2019, the controlling employer did not initiate and maintain a safety program to provide for frequent and regular competent person jobsite inspections in that a representative of the controlling employer observed subcontractor employees  on the jobsite on May 13, 2019 at approximately 12:30 PM performing roofing work at a height greater than 6 feet above ground level not appropriately using fall protection. Subcontractor employees were wearing harnesses that were not attached to any fall protection system. This condition exposed subcontractor employees to fall hazards.  Xcel Roofing of Siouxland, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2) which was contained in OSHA inspection number 1357211, citation number 1, item number 1 and was affirmed as a final order on November 30, 2018, with respect to a workplace located at 7505 West Boysenberry Street, Sioux Falls, SD 57106.
