OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire, explosion, and deflagration hazards: a) On or about 6/7/2019: Finish Line dust collection system: Equipment such as, but not limited to enclosed sanding machines, duct work, dust collecting systems, transport systems and trailer receptacles were being utilized to collect and move combustible wood dust generated during the finishing process. The equipment contained potentially explosive atmospheres during normal operation. The employer did not ensure that the equipment and areas were equipped and maintained with means of protection to prevent explosions, fires and deflagrations in that bonding and grounding was present from the sanding machines to the collecting system duct work. b) On or about 6/7/2019: Flooring Line Dust collection system: Equipment such as, but not limited to duct work, dust collecting systems, transport systems and trailer receptacles were being utilized to collect and move combustible wood dust generated during the flooring manufacturing process. The equipment contained potentially explosive atmospheres during normal operation. The employer did not ensure that the equipment and areas were equipped and maintained with means of protection to prevent explosions, fires and deflagrations in that bonding of all transport piping was not maintained, spark detection was not in place on the feed lines to the collector, deflagration diversion gates were not in place to prevent blast propagation from the exterior of the building to the interior. Abatement certification is required for this item.
