29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) Jobsite: On June 6, 2019 and at times prior thereto employees worked in a 12.5 foot deep trench where only a single, 8 foot high trench box was used. The trench box did not extend at least 18 inches above the top of the vertical side. Employees working within the trench box were exposed to a collapsing hazard from the 4.5 feet of unprotected trench wall. b) Jobsite: On June 6, 2019 and at times prior thereto employees worked in a 12.5 foot deep trench where only a single, 8 foot high trench box was used. Employees working within the trench box were exposed to a collapsing hazard from the spoil pile that was placed at the edge of the trench/excavation. c) Jobsite: On June 6, 2019 and at times prior thereto employees worked in areas of a 12.5 to 15 foot deep excavation where cave-in protection was not in place. Cave-in protection was not used around a manhole vault or from the access ladder to the trench box. A+ Contractors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(1), which was contained in OSHA inspection number 1246170, citation number 1, item 2a, and was affirmed as a final order on August 23, 2017, with respect to a workplace located at 4th South and Spring Creek Drive, Soda Springs, ID, 83276. The top of the trench box did not extend at least 18 inches above the vertical sides, while the excavated walls were not sloped to an appropriate angel for the soil type. c) Jobsite: On June 6, 2019 and at times prior thereto employees entered and worked within a 12.5 to 15 foot deep trench/excavation. The spoil pile of excavated material was located on the edge of the excavation and above the top of the 8 foot high trench box. A+ Contractors, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1246170, citation number 1, item 2b, and was affirmed as a final order on August 23, 2017, with respect to a workplace located at 4th South and Spring Creek Drive, Soda Springs, ID, 83276.
