29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there was an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees:  a) Jobsite: On July 11, 2017 and at times prior thereto an employee was not wearing a hard hat while working near an operating excavator; exposing the employee to an overhead hazard of falling debris.  The employee was working in a 12 foot deep trench, installing rigging on a manhole barrel so it could be lifted and removed.      Note) Certification of corrective action is required for this item.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections were not made after every rainstorm or other hazard increasing occurrence:  a) Jobsite: On July 11, 2017 an inspection of a 12 foot deep trench was not conducted and acted upon by the competent person after a heavy rainstorm and prior to allowing an employee to enter the trench.  An employee entered the muddy trench to install rigging on a manhole barrel and replace a damaged seal.      Note) Certification of corrective action is required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:   a) Jobsite: On July 11, 2017 an employee entered a 12 foot deep trench to hook up rigging equipment and replace a seal on a manhole barrel.  No cave-in protection was in place.    b) Jobsite: On or about July 11, 2017 and at times prior thereto, the protective system used was open on two sides.  This system did not provide cave-in protection for employee(s) on the north and south excavated walls of the trench.     Note) Corrective action certification is required for this item.
