29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Trail Creek Ridge jobsite: On May 9, 2023 and at times prior employees performing catch basin and storm drain installation work in a 7 to 10.9 -foot deep excavation were exposed to hazards which included lack of a proper cave-in protection, lack of safe egress, and the placement of excavated materials and heavy equipment on the edge(s) of the excavation.  The employees had not received sufficient instruction to recognize these hazards as the work progressed, or to take action to correct or minimize these hazards. 29 CFR  1926.251(a)(1): Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it was safe and defective rigging equipment was not removed from service:  a) Trail Creek Ridge jobsite: On May 9, 2023 and times prior, a piece of wire was used in place of a cotter pin on a chain sling clevis pin.  The chain was used for lifting and placing concrete vaults/cones weighing up to 1500 lbs.       b) Trail Creek Ridge jobsite: On May 9, 2023 and times prior,  a grade 70 transport chain was used for lifting and placing concrete vaults/cones weighing up to 1500 lbs.  c) Trail Creek Ridge jobsite: On May 9, 2023 and times prior, the identification tag was missing on a quad leg chain sling. The chain sling was used to lift and place concrete vaults/cones weighing up to 1500 lbs.   d) Trail Creek Ridge jobsite: On May 9, 2023 and times prior, safety latches on a quad leg chain sling hooks were damaged or missing.  The chain sling was used to lift and place concrete vaults/cones weighing up to 1500 lbs.   Note) Certification of corrective action is required for this item.

Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:   a) Employees are exposed to excavated material that is not placed at least two (2) feet back from the edges of an excavation.  This was most recently observed at the Trail Creek Ridge jobsite in Pocatello, Idaho on May 9, 2023.    Note) A+ Contractors, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1407356, Citation 1 Item 2 and was affirmed as a final order on August 14, 2019, with respect to a workplace located at Snow Crest and Harley, Idaho Falls, ID 83401. This was most recently observed at the Trail Creek Ridge jobsite in Pocatello, Idaho on May 9, 2023.     b) A competent person is not on site to conduct an inspection when the work begins, as it progresses or when employees work in areas of the excavation that are 7 to 10.9 feet deep and the spoil piles and heavy equipment are placed at the edges of the excavation. This was most recently observed at the Trail Creek Ridge jobsite in Pocatello, Idaho on May 9, 2023.     c) A competent person is not on site to conduct an inspection when the work begins, as it progresses or when employees work in areas of the excavation that are 7 to 10.9 feet deep without a safe means of egress.
