29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a- Block 26, Lot 12, 109 Atlantic Avenue, Lakewood NJ: Workers were exposed to fall hazards, up to 9 feet to the floor surface below, when walking and working from the top plates of a residential structure's interior walls without the use of fall protection. Condition noted on or about 06/06/19.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:  a- Block 26, Lot 12, 109 Atlantic Avenue, Lakewood NJ: Workers were exposed to fall hazards, up to 9 feet to the floor surface below, when walking and working from the top plates of a residential structure's interior walls without the use of fall protection. Condition noted on or about 06/06/19.   ERS Construction, LLC. was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1351822, citation number 1, item number 1 and was affirmed as a final order on03/12/19, with respect to a workplace located at 21 Hastings Avenue, Medford NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
