29 CFR 1910.1053(d)(4): The employer did not reassess exposures whenever a change in the production, process, control equipment, personnel, or work practices was reasonably expected to result in new or additional exposures at or above the action level, or when the employer had reason to believe that new or additional exposures at or above the action level have occurred. On or about June 24, 2019 and at times prior thereto, the employer did not reassess Concrete Truck Operators exposure to Respirable Crystalline Silica when malfunctioning engineering controls on Batch Plant 12 continued to create additional exposure to operators during the process of loading a batch, exposing employees to the hazards of inhaling Silica dust.
