29 CFR 1910.67(c)(2)(v): (v) A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, shall be worn and attached to the boom or basket when working from an aerial lift.    On or about June 7, 2019, an employee operating an articulating Genie Aerial Lift did not utilize a personal fall arrest system as required.

Synthetic web slings shall be immediately removed from service if any of the following conditions are present; acid or caustic burns; melting or charring of any part of the sling surface; snags, punctures, tears or cuts; broken or worn stitches; or distortion of fittings:    On or about June 7, 2019, synthetic web slings located on a Viper Model FY25 forklift in the fabrication department were not removed from service when they had broken and worn stitches, cuts and tears, and were tied together.

29 CFR 1910.334(a)(2)(ii): If there is a defect or evidence of damage that might expose an employee to injury, the defective or damaged item shall be removed from service, and no employee may use it until repairs and tests necessary to render the equipment safe have been made.    (a)  On or about June 7, 2019, a Dewalt 4 inch angle grinder had a damaged flexible cord that was not removed from service until acceptable repairs were performed.    (b)  On or about June 7, 2019, a flexible cord with metal pendant box utilized as an extension cord had a damaged face plate and missing screws that was not removed from service.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    The employer did not ensure forklift operators were provided forklift training and evaluation prior to allowing employees to operate the forklifts in the fabrication shop.    American Industrial Sales LLC was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 1050788, citation number one, item number one and was affirmed as a final order on August 25, 2015, with respect to a workplace located at N231 State Road 49 North Berlin, WI 54923.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.    (a)  A Baileigh Industrial, Inc. Model SH-012010 (S/N 59232) Shear did not any form of mache guarding to prevent operators from accessing the point of operation and material hold down during the operating cycle.    (b)  A Birmingham CP Tools, Inc. Model NH-1014-6 (S/N 41185) folding machine did not have any form of machine guarding to prevent operators from accessing the point of operation and being struck by the folding arm during the operating cycle.    (c)  A Edwards Mfg. Co. Elite 110/65 Hydraulic Ironworker did not have adequate machine guarding to prevent operators from accessing the point of operation and material hold down of the shear during the operating cycle.  The automatically adjusting guard was removed allowing employees to place their hands in the danger zone.    American Industrial Sales LLC was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 1050788, citation number one, item number two and was affirmed as a final order on August 25, 2015, with respect to a workplace located at N231 State Road 49 North Berlin, WI 54923.
