The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator:  On July 30, 2025, at an establishment located at 242 South Pearl Street, in Berlin, Wisconsin; the employer did not provide a medical evaluation to determine an employee's ability to use a tight-fitting negative pressure half-face respirator (Eclipse P100), which the employee wore under their welding helmet while conducting welding operations.

29 CFR  1910.252(c)(4)(i): All welding and cutting operations carried on in confined spaces shall be adequately ventilated to prevent the accumulation of toxic materials or possible oxygen deficiency. This applies not only to the welder but also to helpers and other personnel in the immediate vicinity. All air replacing that withdrawn shall be clean and respirable:  On July 30, 2025, at an establishment located at 242 South Pearl Street, in Berlin, Wisconsin; in the industrial washer adequate ventilation was not provided during welding operations conducted in the confined space of a tank to prevent the  accumulation of toxic materials, in the form of welding fumes, or possible oxygen deficiency, due to inert welding gases and gas byproducts of welding.

Employers shall ensure that each employee has access to labels on containers of chromium (VI) and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (l)(2) of this section.   On July 30, 2025, at an establishment located at 242 South Pearl Street, in Berlin, Wisconsin; the employer did not provide training to Welder employees in accordance with the hazard communication standard regarding chromium (VI). The employees were not informed of the presence of chromium (VI) in the workplace, the operations that could expose the employees to chromium (VI), the potential health hazards posed by chromium (VI), nor how the employees could protect themselves from the hazards of chromium (VI).
