29 CFR  1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:    (A) A specific statement of the intended use of the procedure;    (B) Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy;    (C) Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them; and    (D) Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures.   At an establishment located at 242 South Pearl Street, in Berlin, Wisconsin, in the Fabrication Area,   (a)  Employees were required to perform servicing and maintenance tasks on Ermaksan hydraulic brake press for tasks such as, but not limited to, die changes, set up activities, servicing and maintenance activities. The procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques, nor did the procedure identify all energy sources such as, but not limited to, gravitational and hydraulic to be isolated for the control of hazardous energy, and the means to enforce compliance.  (b)  Employees were required to perform servicing and maintenance tasks on Edwards Elite 110/65 hydraulic ironworker for tasks such as, but not limited to, set-ups, servicing, and maintenance. The procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques, nor did the procedure identify all energy sources such as, but not limited to, gravitational and hydraulic to be isolated for the control of hazardous energy, and the means to enforce compliance.

29 CFR  1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.  At an establishment located at 242 South Pearl Street, in Berlin, Wisconsin, in the Fabrication Area, the employer did not conduct periodic inspections of their energy control procedures to ensure that the procedures and the requirements of this standard were followed. Employees performed servicing and maintenance tasks on equipment including but not limited to, Ermaksan hydraulic brake press and Edwards Elite 110/65 hydraulic ironworker.

29 CFR  1910.178(p)(1):  If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.  On or about July 30, 2025, at an establishment located at 242 South Pearl Street, in Berlin, Wisconsin, in the Fabrication Area,   (a)  Employees were exposed to hazards related to powered industrial vehicle operations while utilizing the Yale #39 forklift, GLC080LINGAE088, S/N:  D818V02479C, which was missing chunks of rubber, missing strips of rubber, tire wear to safety line on the front left side, rear left side, and rear right side.  (b)  Employees were exposed to struck by hazards while utilizing the Yale #39 forklift, GLC080LINGAE088, S/N:  D818V02479C, when the fork assembly pin was not secured on the left side to prevent the fork from becoming loose or dislodging from the carriage during operation.  (c)   Employees were exposed to struck by hazards while operating the Yale #39 forklift, GLC080LINGAE088, S/N:  D818V02479C, which had a small cut across the fork and holes in the forks that would diminish the forks strength.

29 CFR  1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  On or about the week of June 16, 2025, at an establishment located at 242 South Pearl Street, in Berlin, Wisconsin, in the Fabrication Area, employees conducting punching activities on the Edwards Elite 110/65 hydraulic ironworker were exposed to struck-by, caught-in hazards created by unguarded opening on the right side. The point of operation was not effectively guarded to prevent exposure to these hazards.

29 CFR  1910.27(a):  Scaffolds.  Scaffolds used in general industry must meet the requirements in 29 CFR part 1926, subpart L (Scaffolds).              See 29 CFR 1926.451(g)(4):  Guardrail systems installed to meet the requirements of this section shall comply with the following provisions (guardrail systems built in accordance with appendix A to this subpart will be deemed to meet the requirements of paragraphs (g)(4) (vii), (viii), and (ix) of this section)  On or about July 29, 2025, at an establishment located at 242 South Pearl Street, in Berlin, Wisconsin, in the Fabrication Area, the Skyjack scissors lift used to elevate employees while performing welding activities on the top of the washer unit was missing the mid rail at the entry point exposing employees to fall hazards.

On or about July 1, 2025 and thereafter, at an establishment located at 242 South Pearl Street, in Berlin, Wisconsin, in the Fabrication Area,  the employer did not ensure that personnel operating  Yale #39 forklift, GLC080LINGAE088, S/N:  D818V02479C, had been been re-evaluated every three years, as required by the standard.
