29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling: (a)Adams Thermal Systems, Inc. at 47920 5th Street West, Canton, SD 57013: On or about and at times prior to July 2, 2019, the employer did not ensure that an employee was protected from a fall hazard. An employee was working on the upper area of CAB 2 during the removal process without a fall protection system. This condition exposed an employee to a fall hazard of approximately 7 feet.

29 CFR 1910.30(a)(1): The employer did not provide training before any employee was exposed to a fall hazard for each employee who uses personal fall protection systems, or who is required to be trained as specified elsewhere in this subpart: (a)Adams Thermal Systems, Inc. at 47920 5th Street West, Canton, SD 57013: On or about and at times prior to July 2, 2019, the employer did not ensure that each employee was trained to recognize potential fall hazards and/or in the use of fall protection systems. An employee accessed the top of the CAB 2 area to remove utilities without fall protection. This condition exposed an employee to a fall hazard of approximately 7 feet.
