29 CFR 1926.652(g)(2): Excavations of earth material to a level no greater than 2 feet (.61m) below the bottom of a shield was permitted: (a) Jobsite, South & Franklin Streets, Johnstown, PA: On or about July 2, 2019 approximately 38-40 inches below the 8' x 8' shield was exposed and did not provide adequate cave-in protection. The depth of the excavation was approximately 11 1/2 feet and approximately 3 1/2 feet below the box was unprotected exposing employees to potential cave-in hazards.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation: (a) Jobsite, South & Franklin Streets, Johnstown, PA: On or about July 2, 2019 water had accumulated in the excavation and was not being pumped out. A shield was being used but was not installed properly leaving approximately 38-40 inches of exposed sidewall below the shield and did not provide adequate cave-in protection.
