29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) New townhome construction located on Lot #50 and Lot #51, Ground level: On or about 07/15/2019, and at times prior, the employer exposed employees to overhead struck-by hazards, in that head protection was not provided or donned prior to the start of work. Employees working on the ground level worked directly below employees installing ceiling joists.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  (a) New townhome construction located on Lot #50, Second level top plate: On or about 07/15/2019, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that employees were not provided with protective eyewear while operating these tools at 120 PSI. Employees using these tools were exposed to struck-by hazards which include wood debris, plastic collated fragments, and 3-inch fasteners.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) New townhome construction located on Lot #50, Second level top plate: On or about 07/15/2019, and at times prior, the employer exposed employees to fall hazards of over 20-feet, 7-inches to the lower level, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  (a) New townhome construction located on Lot #50 and Lot #51, Ground level: On or about 07/15/2019, and at times prior, the employer failed to inspect all the electrical cords prior to the start of the work shift. A 50-ft. flexible cord used to power a Makita (Model 5007F) 7-1/4-inch circular saw had a torn outer casing, missing strain relief, and a missing ground pin and was not removed from service before the shift.
