29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Bryer Co. LLC worksite located at the entrance to Timbers Edge Subdivision, Sylvania Township, Ohio: On or about July 18. 2019, the employer did not ensure employees were protected from falls installing shingles on a single story Guard Shack structure. The employees were exposed to a fall distance of approximately 11 feet from a steep slope roof to asphalt surface.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Bryer Co. LLC worksite located at the entrance to Timbers Edge Subdivision, Sylvania Township, Ohio: On or about July 18. 2019, the employer did not ensure the side rails of the extension ladders being used on the side of a single story guard shack structure was not extended at least three feet above the landing surface. One employee was exposed to falls while using the ladder to access the roof.
