29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:    a) On or about 7/18/19 at a roof project located at 443 Parkside Avenue, Buffalo, New York; employees replacing roofing were using ropes with rope grabs attached to their harnesses. The employees did not have their rope grabs adjusted or rigged to prevent free falls more than 6 feet.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:    a) On or about 7/18/19 at a roof project located at 443 Parkside Avenue, Buffalo, New York; employees performing roofing activities from a ladder jack scaffold approximately 16 feet high and were not protected from falling by a personal fall arrest system.    NO ABATEMENT CERTIFICATION REQUIRED    Dalex Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1091183, citation number 1, item number 1 and was affirmed as a final order on 10/15/15, with respect to a workplace located at 39 Groveland Street, Buffalo, New York.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a) On or about 7/18/19 at a roof project located at 443 Parkside Avenue, Buffalo, New York; employees were replacing shingles on the roof of a two story house. The roof had a 7 in 12 pitch and an eave height of approximately 20 feet. All employees were not protected from falling.    NO ABATEMENT CERTIFICATION REQUIRED    Dalex Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1091183, citation number 1, item number 2 and was affirmed as a final order on 10/15/15, with respect to a workplace located at 39 Groveland Street, Buffalo, New York.
