29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:  a) On or about 3/5/2020 at a roof project located at 256 Pennsylvania Street, Buffalo, New York; an employee was using a ladder jack scaffold, with the scaffold brackets and platform to the outside of the supporting ladders. The employee accessed the platform by climbing the supporting ladders and climbing around the bracket and platform.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill:  a) On or about 3/5/2020 at a roof project located at 256 Pennsylvania Street, Buffalo, New York; employees replacing roofing were using a personal fall arrest system with rope grabs attached to their harnesses. The employees did not have their ropes properly rigged nor were their legs through the harnesses to prevent them from falling out or through the harness. Employees did not demonstrate the appropriate skill or understanding of personal fall arrest systems.   NO ABATEMENT CERTIFICATION REQUIRED

The roof had a 7 in 12 pitch and an eave height of approximately 20 feet. All employees were not protected from falling. The employees did not have their rope grabs adjusted or rigged to prevent free falls more than 6 feet.
