29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) 3216 West Ave, Ocean City, NJ, 2nd Floor Deck, East Side of Home - An employee without any means of fall protection approximately 20 feet above ground level, was standing on the platform resting on the forks of a Lull 844C-42 Telehandler, while off loading materials and equipment, on or about 07/23/2019. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) 3216 West Ave, Ocean City, NJ, 2nd Floor Deck, East side of home - Two to three employees without any means of fall protection, were exposed to an approximate 20 foot fall from the deck to the ground below, while attaching 4' x 8' ZIP System panels to the exterior wall, on or about 07/23/2019; b) 3216 West Ave, Ocean City, NJ, Roof Top above 2nd Floor Deck, East side of home - An employee without any means of fall protection was taping the seams for the ZIP System roof panels on the 7/12 pitch roof, on or about 07/23/2019. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
