A)     Samuel Moreno Construction, LLC, conducting work at 120 Ratcliff Lane, Plain City, OH 43064: On or about July 25, 2019, the employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as, but not limited to, falls during job site operations.

Employees were exposed to approximately 20 feet fall hazard from the roof of the structure to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   A)     Samuel Moreno Construction, LLC, conducting work at 120 Ratcliff Lane, Plain City, OH 43064: On or about July 25, 2019, the employer did not ensure that employees were adequately trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection while conducting roofing activities atop the two story residential structure. Employees were exposed to approximately 20 feet fall hazard from the roof of the structure to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   A)     Samuel Moreno Construction, LLC, conducting work at 120 Ratcliff Lane, Plain City, OH 43064: On or about July 25, 2019, the employer did not ensure that the extension ladder, used to access the roof of the two story residential structure, was extended at least 3 feet above the landing surface. The employees were exposed to approximately 11 feet fall hazards when using the ladder to access the working level in order to conduct roofing activities.
