29 CFR  1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:  a. In regards to citation 1, item 1, issued on December 21, 2022, the employer has failed to submit abatement certification and documentation within 10 days of the abatement date, January 3, 2023. The violation read as follows:   29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a. Located at 8872 Coe Drive, Plain City, Ohio 43064: On or about September 7, 2022, the employer did not ensure that employees were protected from falls while performing framing work from the partially unsheathed roof trusses of the house, thereby exposing employees to falls from approximately eleven feet.?   Samuel Moreno Construction, LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1454551, citation number 2, item number 2 and was affirmed as a final order on March 20, 2020, with respect to a workplace located at 4733 Winding Oak Drive, Delaware, 43015.   Samuel Moreno Construction, LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1418882, citation number 1, item number 2 and was affirmed as a final order on November 5, 2019, with respect to a workplace located at 120 Ratcliff Lane, Plain City, OH 43064.
