29 CFR 1926.651(b)(4): While the excavation was opened, underground installations were not protected, supported or removed as necessary to safeguard employees: (a)Winter Contracting LLC at South Elm Street, Central Basin 2 Project, Lennox, SD 57039: On or about and at time prior to July 29, 2019, the exposing employer did not ensure that exposed utilities in three of six open excavations on the Central Basin 2 project were supported, protected, or removed to safeguard employees and subcontracted employees. The project had several open excavations with multiple gas lines that were not supported. This condition exposed employees to fire and explosion hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a)Winter Contracting LLC at South Elm Street, Central Basin 2 Project, Lennox, SD 57039: On or about and at time prior to July 29, 2019, the controlling employer did not ensure subcontractor employees conducting work in an excavation were protected from cave-in hazards. Subcontractor employees were working in an unprotected excavation installing box inlets which lacked an adequate protective system, such as sloping, benching, or shielding system. This condition exposed employees to cave-in hazards within an excavation approximately 8 feet deep.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and into which employees could fall, was not guarded to eliminate the hazard of impalement: (a)Winter Contracting LLC at South Elm Street, Central Basin 2 Project, Lennox, SD 57039: On or about and at time prior to July 29, 2019, the employer did not ensure that exposed rebar in an approximately seven foot deep excavation was properly guarded to protect employees from impalement hazards in an event of a fall into the excavation. This condition exposed employees to an impalement hazard.
