29 CFR 1926.453(b)(2)(iv): Employee(s) working in an aerial lift were sitting or climbing on the rails of the basket: a. 2301 Atlantic Ave., Manasquan, NJ - Nationwide Imaging Project The employer, SJK Steel and Construction, LLC, did not ensure a safe means of access to the roof for employees engaged in steel erection activities. An employee was observed to access the roof of the steel structure by climbing the rails of a Genie telescoping boom aerial lift. Violation observed on or about August 7, 2019 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems: a. 2301 Atlantic Ave., Manasquan, NJ - Nationwide Imaging Project The employer did not ensure that SJK Steel and Construction, LLC employees were protected from falls by use of safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. Employees were working/walking on the roof of a steel building without any means of fall protection available exposing him to a fall hazard of approximately 20 feet to the ground below. Violation observed on or about August 7, 2019 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
