Employees were installing water mains in an excavation approximately 8 feet in depth which lacked an adequate protective system, such as sloping, benching, or shielding system. This condition exposed employees to cave-in hazards within an excavation 8 feet deep.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  (a)Winter Contracting LLC, 4th and Juniper Street, Central Basin 2 Project, Lennox, SD 57039:  On or about and at times prior to August 15, 2019, the exposing employer did not ensure a competent person inspected the excavation prior to start of work and during each shift in that the competent person did not identify the lack of an appropriate protective system and did not take prompt corrective action to eliminate the cave-in hazard. This condition exposed the employee to the hazards of working near the sides of an unprotected excavation approximately 8 feet in depth.    Abatement Note:  "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
