29 CFR 1926.502(h)(1)(v): The employer permitted the safety monitor to have other responsibilities which could take the monitor's attention from the monitoring function: a) At The End Zone, on or about 8/20/2019: The monitor performed non-monitoring responsibilities, such as, but not limited to: handing tools and materials to laborers, while workers were working at the edge of the roof. b) At The End Zone, on or about 8/20/2019: The monitor performed non-monitoring responsibilities, such as, but not limited to: inspecting a roof area on the opposite side of the building, away from the workers, without maintaining view of the workers that were at the edge of the roof.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill: a) At The End Zone, on or about 8/20/2019: The monitor performed non-monitoring responsibilities, such as, but not limited to: handling tools and materials to laborers, while workers were working at the edge of the roof. Retraining nor discipline was done with the monitor to correct this action. b) At The End Zone, on or about 8/20/2019: The monitor performed non-monitoring responsibilities, such as, but not limited to: inspecting a roof area on the opposite side of the building, away from the workers, without maintaining view of the workers that were at the edge of the roof. Retraining nor discipline was done with the monitor to correct this action.
