29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about August 23, 2019, the employer did not fully document the training of the operator of a Hitachi Zaxis 350 Hydraulic Excavator as to where to attach the employers high-visibility fiberglass magnetic safety barrier rods to the counterweight of the excavator, one at each side and one at the center of the rear of the excavator, to prevent anyone from walking into the swing radius pattern of the excavator.
