29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, and rotating parts: A) Bun Oven Loader #2 -On or about 08/23/19, and at times prior thereto, employees recovered/recycled organic everything bagel topping from Eastern Bakery Equipment Model LDR2 Bun Oven Loader #2. The OEM machine safety guards were removed, and workers came in close proximity to nip points created by the lower section of the conveyor band and the fixed parts of the structure and to an unprotected chain and sprocket system that powered a section of the conveyor. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.219(f)(3): Sprocket wheels and chains which were seven (7) feet or less above floors or platforms were not enclosed: b) Plant - On or about 08/23/19 and at times prior thereto employees recovered/recycled bagel topping form the wing loader in Oven #2.
