29 CFR 1926.503(c)(3): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: a) Garage roof - On or about August 27, 2019 and at times prior thereto, employees were replacing the shingle roof of a residential detached garage without the use of fall protection. Employees had been trained but still were not adequately using fall protection, instead using slide guards as the only protection. On August 27, 2019 an employee fell from the roof resulting in multiple injuries that required hospitalization.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Garage roof - On or about August 27, 2019 and at times prior thereto, employees were replacing the shingle roof of a residential detached garage without the use of fall protection. On August 27, 2019 an employee fell from the roof resulting in multiple injuries that required hospitalization. The Adirondack Roofing, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1055761, citation number 1, item number 1 and was affirmed as a final order on 5-12-2015, with respect to a workplace located at 3820 Lake Shore Drive, Diamond Point, NY 12824.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye: a) Garage roof - On or about August 29, 2019 and at times prior thereto, the employer did not report an employee hospitalization that occurred on August, 27, 2019. The hospitalization was reported by the Sheriff's office and received on August 28, 2019. On site inspection did not begin until August 29, 2019 and the work site was no longer active. Employer was not reached for an opening conference until September 3, 2019.
