29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Zarley Inc. located at 1605 Dickson Drive, Marysville, OH 43040: On and preceding September 10, 2019, the employer did not ensure that a safe means of egress was located in a trench that was more than 4 feet deep. Employees were installing a water line through the entire length of a trench that was 60 feet long and was more than 4 feet in depth. The trench did not have a ladder, ramp or other means for the employees to egress. The following condition exposed employees to struck-by/caught-in hazards.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) Zarley Inc. located at 1605 Dickson Drive, Marysville, OH 43040: On and preceding September 10, 2019, the employer did not ensure that protection was provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of trench. Employees were installing a water line through the entire length of a trench that was 60 feet long and was more than 4 feet in depth. The spoils pile ran along the far edge of the trench which was approximately 60 feet of excavated material including loose soil, rocks and large clumps of dirt. The following condition exposed employees to struck-by/caught-in hazards.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) Zarley Inc. located at 1605 Dickson Drive, Marysville, OH 43040: On and preceding September 10, 2019, the designated competent person on site did not removed exposed employees from hazardous conditions with the trench that he was aware of. Employees were installing a water line through the entire length of a trench that was 60 feet long and was more than 4 feet in depth. The spoils pile ran along the far edge of the trench which was approximately 60 feet of excavated material including loose soil, rocks and large clumps of dirt. The trench did not have a means of egress in place for employees to safely exit. The following condition exposed employees to struck-by/caught-in hazards.
