29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (Construction Reference 1926.103)  a) 1704 Walnut St., Philadelphia, PA 19103 - The employer did not establish and implement elements of a written respiratory protection program for employees, who voluntarily wear 3M 6000 Series half-face respirators, to ensure the employees are medically able to use a respirator and that the respirator was cleaned, stored and maintained so that its use does not present a health hazard to users. This condition was observed on or about September 10, 2019.  Espana Brothers Corporation was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1328468, citation number 1, item number 1, group a, and was affirmed as a final order on January 16, 2019, with respect to a workplace located at 2123 Susquehanna Ave., Philadelphia, PA 19125.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) 1704 Walnut St., Philadelphia, PA 19103 - The employer did not ensure that employees who were performing demolition activities on the roof of a building with unprotected edges up to approximately 22 feet above the lower level were protected by guardrails, safety nets, personal fall arrest systems, or an alternative measure, thus exposing the employees to fall from height hazards.  This condition was observed on or about September 6, 2019.   Espana Brothers Corporation was previously cited for a violation of an equivalent occupational safety and health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1328468, citation number 1, item number 3, group a, and was affirmed as a final order on January 16, 2019, with respect to a workplace located at 2123 Susquehanna Ave., Philadelphia, PA 19125.
