29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  The employer failed to provide documentation demonstrating the abatement methods and completion as cited in Citation 1 Item 1 for hazards associated with overhead hazards and lack of protective helmets and Citation 1 Item 2 for hazards associated with eye/face hazards and lack of eye protection.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about September 12, 2019, the employer did not ensure that protective helmets were worn by employees clearing materials on the ground during roofing activities on a residential home located at 7070 Antoinette Drive, Parma, OH 44129.     Dave Tackett Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.100(a), which was contained in OSHA inspection number 1105628, citation number 1, item number 1, and was affirmed as a final order on December 28, 2015, with respect to a workplace located at 3900 Wildlife Way, Cleveland, OH, 44109.

The distance from the roof peak to the ground level below was 13.6 feet.  Dave Tackett Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.501(b)(10), which was contained in OSHA inspection number 1105628, citation number 1, item number 3, and was affirmed as a final order on December 28, 2015, with respect to a workplace located at 3900 Wildlife Way, Cleveland, OH, 44109.
