OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) On or about and at times prior to September 6, 2019, an employee working as a painter was exposed to the hazards of high ambient temperature, which produced an indoor Wet Bulb Globe Temperature (WBGTi) of 88.8 degrees Fahrenheit (Heat Index of 125 degrees Fahrenheit), while working in a heated spray painting booth and paint mixing room. Such exposures may lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat exhaustion, and heat stroke.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. a) At the facility located at 7208 Golden Wing Rd, Jacksonville, FL: On or about September 9, 2019, the employer was notified of an employee in-patient hospitalization due to a work related heat stress injury, but failed to report the hospitalization to OSHA within 24 hours.
