29 CFR 1910.29(b)(1): The employer must ensure guardrail systems meet the following requirements: The top edge height of top rails, or equivalent guardrail system members, are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking/working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11 of this section): A) Rindler Poultry, LLC, located at 5424 Watkins Road, Saint Henry, OH 45883: On or about June 20, 2019, the employer did not ensure that the top rails of the guardrail systems, located in front of the egg-collecting conveyors at the second floor of the House # 3, were at least 39 inches above the walking-working surface. Employees were exposed to fall hazards from the walking-working surface on the second floor to the horizontal conveyor below.

Employees were exposed to fall hazards from the walking-working surface on the second floor to the horizontal conveyor below.

29 CFR 1910.219(f)(3): Sprocket wheels and chains which were seven (7) feet or less above floors or platforms were not enclosed: A) Rindler Poultry, LLC, located at 5424 Watkins Road, Saint Henry, OH 45883: On or about June 20, 2019, the employer did not ensure that one or more methods of adequate machine guarding were provided to protect employees from hazards such as, but not limited to, the nip point created between the chain and the sprocket of the egg-collecting conveyor on line # 7 located at the second floor of the House # 3. Employees were exposed to nip point hazards that could result in amputations.
