29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were made without the manufacturer's written approval: (a) On or about October 17, 2019, the employer failed to get the manufactures approval prior to attaching the job-made wooden trash box onto the JLG 8042 telehandler. The employer was hauling construction debris. Workers were expose to a struck-by hazard. (b) On or about October 17, 2019, the employer failed to get the manufactures approval prior to attaching the job-made wooden trash box onto the JCB 510-56 telescoping forklift . The employer was hauling construction debris. Workers were expose to a struck-by hazard.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: Part III Section 6 Instance 3. 606A: If at any time a powered industrial truck is found in need of repair, defective or in any way unsafe, the matter shall be reported immediately to the designated authority, and the truck shall be taken out of service until it has been restored to safe operating condition. Part III Section 7 Instance 702 maintenance and inspection of all powered industrial trucks shall be performed in conformance with the manufacturers recommendation. On or about October 17, 2019, the linch pin for attaching the forks to the JCB 510-56 telescopic forklift was replaced by a nail. The JCB was used to move scrap boxes and place material and trusses on the roof. Employees were exposed to a struck-by hazard from material falling and/or fork attachment failure.
