29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a.  On or about October 24, 2019, at the above addressed jobsite, an employee working on the ground, below roofing activities, was not wearing a hard hat to protect against falling materials and debris.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  The employer does not ensure the protection equipment is used when employees are exposed to fall hazards while working above six (6') feet. the lack of fall protection was most recently observed on October 24, 2019, at the jobsite located at 251 Canterbury Ln., Bolingbrook, IL.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.  Domingo Garcia dba DNR Construction was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1, citation number 1a, item number 1242280 and was affirmed as a final order on 12/05/2017, with respect to a workplace located at 19524 Brookridge Drive in Tinley Park, IL.  Domingo Garcia dba Domingo Construction Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1318008, citation number 2, item number 1 and was affirmed as a final order on 08/01/2018, with respect to a workplace located at 11134 Third St. in Mokena, IL.  D & R Construction Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard  29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1408285, citation number 2, item number 1 and was affirmed as a final order on 07/24/2019, with respect to a workplace located at 902 W Hawthorne Blvd. in Wheaton, IL.  D & R Construction Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1412227, citation number 2, item number 1 and was affirmed as a final order on 12/03/2019, with respect to a workplace located at 11336 Preakness Dr. in Plainfield, IL.
